Terms and Conditions

Public Offer Agreement for the Sale of Goods

This document constitutes the official public offer of the MakGraceDancewear.com online store, hereinafter the “Seller”, to enter into a distance retail sale contract on the terms set out below.

Revision date: 29 July 2026.

1. Terms and scope

  • Website — online store MakGraceDancewear.com and its language versions.
  • Buyer — an individual or legal entity placing an order.
  • Consumer - an individual purchasing goods for personal needs not directly related to business or professional activities.
  • Product — products presented on the Site and included in a confirmed order.
  • Standard product — pre-made goods from the Seller’s regular assortment.
  • Individual product - a product manufactured or significantly modified to individual measurements, specifications or personal requirements of the Buyer.
  • Order — a request issued by the Buyer for the purchase of selected goods and delivery services.

Mandatory rights granted by law to a Consumer apply only to a person and relationship that meets the statutory definition of a consumer contract. The terms of this agreement and the general rules of contract law without special consumer guarantees apply to orders of legal entities and individuals purchasing goods for business or professional activities, unless the law provides otherwise.

2. Status of the offer and conclusion of the contract

  • The placement of goods on the Site is an invitation to place an order, unless a specific offer expressly states otherwise.
  • By placing an order, the Buyer confirms that he has read this offer, the description of the product, its size and characteristics, price, terms of payment, delivery and return.
  • An automatic message about the receipt of an order only confirms the transfer of the order to the information system and does not mean unconditional acceptance of the order by the Seller.
  • The contract is considered concluded after confirmation of the order by the Seller, acceptance of payment, or transfer of the goods for processing or shipping - depending on which of these actions first clearly confirms acceptance of the order by the Seller.
  • If, after payment, the order cannot be fulfilled due to the lack of goods, an obvious technical error in the price or description, impossibility of delivery, legal restrictions, reasonable suspicion of a fraudulent transaction or other objective circumstances, the Seller has the right to cancel the order in whole or in part and return the corresponding amount received. This right does not allow arbitrary discriminatory cancellation of a confirmed order.

3. Product information

  • The main characteristics of the product, available sizes, color, composition and other essential information are indicated on the product page.
  • The buyer is obliged to check the selected model, size, color, quantity and other parameters before placing an order. Size tables and manager consultation are for informational purposes only and assume that the Buyer has provided accurate measurements.
  • Slight differences in shade due to screen settings, shooting lighting or batch tolerances are not in themselves a fault as long as the product is generally as described and ordered.
  • Permissible technological deviations in dimensions, pattern location, decor and finishing can only be taken into account when they are normal for the relevant product, do not affect the purpose and are clearly communicated to the Buyer in advance.
  • The Seller does not replace the ordered product with another without the Buyer’s consent, except in cases expressly permitted by law and previously agreed upon by the parties.

4. Individual orders

  • Before production begins, the parties agree on individual measurements, design changes, color, decor, personalization, price and estimated time.
  • The buyer is responsible for the accuracy of self-provided measurements, images, name writing, logo and other initial data. If an error occurs in the data provided by the Buyer, the necessary rework or new production will be paid for by the Buyer.
  • Once the individual specification has been confirmed, changes are accepted only with the consent of the Seller and may result in a change in price and term.
  • Cancellation of an individual order after production has begun is permitted only in cases provided by law. The seller has the right to withhold or demand actually incurred and documented expenses to the extent permitted by law.
  • The right to reject a quality product may not apply if the product is truly made to individual measurements or specifications, is clearly personalized, or objectively cannot be sold to another person without significant loss.
  • Custom manufacturing does not limit the Buyer's rights in the event of a manufacturing defect, Seller error, or product failure to meet the agreed specification.

5. Price, currency and payment

  • Basic prices are indicated in hryvnias. Prices in other currencies may be shown for convenience or used for international payments, depending on your order settings and payment service.
  • The final amount, debit currency, delivery cost and additional payments known to the Seller are shown before confirming the order.
  • Available payment methods:
    • cash on delivery - only for Ukraine, with the commission of the carrier or payment intermediary shown before registration;
    • online payment via MonoPay and WayForPay with cards from Ukrainian and foreign banks;
    • bank transfer - if such a method is available for a specific order.
  • For a cash-on-delivery order, the Seller may request an advance payment of up to UAH 300; the amount payable on delivery is reduced by the advance paid. If, after the order has been handed over for dispatch, the Buyer refuses delivery for a reason attributable to the Buyer, fails to collect the parcel within the storage period or the shipment is returned to the Seller, the advance may be applied in full or in part against the Seller's actually incurred and documented order-processing, delivery and return costs—up to UAH 300 and only to the extent permitted by mandatory law. In the event of a Seller error or confirmed manufacturing defect, the advance is refunded in full and the Seller bears the necessary delivery and return costs.
  • Detailed payment terms are published on the “Payment” page.
  • Commissions of the Buyer's bank, conversion and exchange rate differences are determined by the bank or payment system and are not controlled by the Seller.
  • The Buyer must use a legitimate payment instrument and, upon reasonable request, provide information necessary to verify the payment without providing the full card number, PIN or confirmation codes.
  • If there is reasonable suspicion of an unauthorized or fraudulent transaction, the Seller has the right to suspend order processing for the period of reasonable verification or cancel the order and return the amount received to the rightful payer.

6. Taxes, import VAT and duties

  • Unless otherwise expressly stated at checkout, import VAT/VAT, duties, brokerage, carrier fees and customs clearance are not included in the item and shipping price.
  • Such payments are calculated according to the rules of the country of receipt and are paid by the Buyer. Detailed information is available on the page "VAT and duties".
  • The buyer is obliged to provide the necessary information for customs clearance and timely pay mandatory payments.
  • Amounts paid to government agencies, a carrier, broker, bank or other third party and not received by the Seller will not be refunded by the Seller. The buyer independently applies for a possible return of such amounts to their recipient.

7. Order completion and cancellation

  • The period of production, packaging and transfer to the carrier may differ from the period of transportation itself. For individual and out-of-stock goods, the deadline is agreed separately.
  • The buyer has the right to request cancellation of an order before it has been dispatched. If production of a customized product has already begun or the Seller has incurred special costs at the request of the Buyer, the consequences of cancellation are determined by the nature of the product, the stage of execution and applicable law.
  • After transfer of the standard product to the carrier, cancellation is considered as a refusal of the distance contract or a return in accordance with section "Delivery and return".

8. Delivery

  • In Ukraine: Delivery is carried out by Nova Poshta to the office, parcel terminal or courier. The estimated delivery time is 1–4 business days after the order is transferred to the carrier.
  • Outside Ukraine: Available methods, approximate terms and costs are shown when placing an order or are agreed upon separately.
  • The buyer is obliged to provide complete and correct recipient information and receive the shipment in a timely manner.
  • If a carrier is selected or proposed by Seller, the risk of accidental loss or damage shall pass at the time required by applicable law. The terms of the agreement with the carrier do not deprive the Buyer of mandatory requirements for the Seller.
  • If the Buyer independently assigned delivery to a carrier that was not proposed by the Seller, the moment of transfer of risk is determined by applicable law and the terms of such assignment.
  • Stated periods are indicative unless a guaranteed period is expressly agreed upon. Delays due to customs control, hostilities, carrier restrictions, natural disasters, infrastructure failures and other circumstances beyond our control may extend the period, but do not waive Buyer's mandatory rights in the event of non-delivery.
  • Full rules are posted on the page "Delivery and return" and are part of this agreement.

9. Receipt of goods

  • Upon receipt, the Buyer is recommended to check the number of pieces, the integrity of the packaging and the presence of visible damage.
  • In case of damage, it is necessary, if possible, to inspect the goods with a representative of the carrier, draw up a report and take photographs or videos.
  • If a hidden defect could not be detected during normal inspection, the absence of a carrier's report does not in itself abrogate the Buyer's mandatory rights. However, the Buyer must report the problem without unreasonable delay after discovering it.
  • It is recommended that you save the packaging, invoice, labels and order documents until the inspection is completed.

10. Non-receipt and refusal of shipment

  • Failure to appear for a parcel, refusal to receive it, non-payment of duties or failure to provide customs documents does not replace an unequivocal message of refusal from the contract.
  • If a shipment is returned due to incorrect information, no-show, refusal to receive, failure to pay mandatory import charges, or Buyer's inaction, a refund will be issued upon receipt and inspection of the item unless otherwise required by mandatory law.
  • The Seller has the right to deduct documented costs for return transportation, storage, redirection and customs clearance caused by the actions or inactions of the Buyer, only to the extent permitted by mandatory legislation.

11. Right of return and withdrawal from the contract

  • The procedure, terms, exceptions, distribution of costs, requirements for the condition of the goods and refunds are defined in detail on the page "Delivery and return".
  • To make a return, the Buyer must send a clear message in a timely manner, indicate the order number and receive up-to-date instructions.
  • The item must be sent with tracking, no cash on delivery and no unreasonable charges for the recipient.
  • For international returns, the customs declaration must indicate “return of goods to the seller / returned goods”.
  • Violation of an organizational instruction does not waive a right that cannot be waived by contract, but the Buyer bears the risk of additional costs or delays that could have been avoided.

12. Condition of the returned item

  • Only inspection and fitting is permitted to the extent permitted by applicable law.
  • Item must not show signs of wear, training, performance, photo shoot, washing, ironing, repair, adjustment, cosmetics, sweat, perfume, smoke, dirt, hair, fur, stretching, snags or other damage.
  • Bodysuits, swimsuits, overalls, special dance panties and products with sewn-in panties or shorts are allowed to be tried on only over your own clean underwear and without breaking the hygienic seal.
  • The seller has the right to record the opening of the return and the condition of the goods in a photo or video and draw up an internal report.
  • If the Buyer handles the goods more than is necessary for normal inspection, the refund amount may be reduced by the objective amount of loss of value. In case of complete loss of commercial value, the permissible reduction may reach the full price of the goods - within the limits permitted by mandatory legislation.
  • Substitution of a product, return of an incomplete set or another product does not create the right to a refund of its value. The seller has the right to transfer materials to the competent authorities and payment service.

13. Items Excluded from the Right of Withdrawal

To the extent permitted by applicable law, the right to refuse quality goods does not apply to:

  • goods made to individual measurements or specifications, significantly altered or clearly personalized;
  • goods that, for objective reasons, cannot be sold to another Buyer or can only be sold with a significant loss of value;
  • goods that, by purpose, design, labeling and legislative classification, belong to underwear, corsetry, sanitary hygiene items or other non-returnable category established by law;
  • sealed goods that are not suitable for return for health or hygiene reasons after the Buyer has broken the seal, security sticker or packaging;
  • other goods for which mandatory applicable legislation establishes an exception.

Products with possible hygienic restrictions include special dance panties, bodysuits, swimsuits, jumpsuits, separate tops intended and labeled as underwear, as well as skirts, dresses and other products with sewn-in panties or shorts directly adjacent to intimate areas of the body. A specific exception applies only if there are signs provided for by law.

The limitations of this section do not apply to confirmed manufacturing defects, Seller error, or product failure to conform to a confirmed order.

14. Exchange

  • International direct exchanges of size, color or model are not guaranteed and will usually be processed as a return of the previous item and a separate new order.
  • If the Buyer independently selects the wrong size, color or model, he will pay the costs of return and new order in cases and sizes permitted by law.
  • New merchandise will not be reserved until the return has been received and inspected unless otherwise confirmed in writing by Seller.
  • Exchanges are not permitted for quality items that are legally excluded from exchange or refund.

15. Defect, Seller's error and quality control

  • In the event of a suspected defect, damage, incomplete delivery, or Seller error, the Buyer must provide the order number, describe the problem, and provide available photographs or videos prior to shipment.
  • The seller has the right to check the goods and, if necessary, organize an examination to determine the cause of the defect.
  • Until confirmed by inspection results or obvious evidence, the presence of a manufacturing defect is not automatically established.
  • If the Seller's liability is confirmed, the solution provided for by law is applied: repair, replacement, proportionate reduction in price or refund.
  • The sequence of protection methods is determined by mandatory legislation. A request for an immediate refund of the full price will not be automatically granted if applicable law allows Seller to first correct, repair or replace the product.
  • The Seller will pay or reimburse the necessary reasonable costs of the agreed return method. Self-selected expensive or express delivery without approval can only be reimbursed up to the cost of a reasonable standard method, unless otherwise required by law.
  • Damage due to normal wear and tear, improper care, mechanical stress, excessive stretching, DIY modification, failure to follow instructions, or improper use is not considered a manufacturing defect.
  • If the inspection confirms the absence of a manufacturing defect and the presence of damage due to the fault of the Buyer, the Seller has the right to demand compensation for allowable diagnostic and transportation costs, subject to prior notice and to the extent permitted by law.

16. Warranty

  • The MakGrace warranty period for manufacturing defects in materials, seams and fittings is 6 months from the moment you receive the goods. This period does not limit the Buyer’s mandatory rights and legal deadlines for filing claims established by applicable law.
  • The MakGrace warranty does not cover normal wear and tear, improper care, mechanical damage, damage to the decor during use, excessive stretching, DIY repairs or misuse.
  • The stated warranty period does not cancel or reduce the Consumer's mandatory legal rights, including rights in relation to custom-made goods that have a defect or do not conform to the agreed specification.

17. Refund

  • The refund amount will be determined based on the reason, contents of the returned order, condition of the item, applicable costs and applicable laws.
  • Refunds are made using the same payment method, unless the Buyer has expressly agreed on a different method.
  • In the event of a complete legal refusal by a Consumer from the EU, EEA or UK, the cost of the goods and the cheapest standard original delivery will be refunded. Additional payments for more expensive delivery methods are non-refundable.
  • The Buyer pays the direct cost of international return shipping for a conforming product, provided that the Buyer was informed of this obligation in advance and mandatory law does not require otherwise.
  • For EU and EEA, the Seller has the right to withhold returns until receipt of the goods or adequate evidence of their actual dispatch. Preliminary return based on proof of shipment does not deprive the Seller of the right to demand compensation for any substitution, damage, incomplete set or objective loss of value discovered after receipt.
  • Import taxes, duties, brokerage fees, Buyer's bank commissions and other amounts not received by the Seller will not be refunded by the Seller.
  • The crediting period after the refund is processed depends on the bank and payment system.

18. Promotions, bundles and gifts

  • Only the amount actually paid for the item will be refunded.
  • In case of partial return of a set or goods purchased with a quantity discount, the amount can be recalculated in accordance with the terms of the promotion communicated to the Buyer before payment.
  • A gift provided as a condition of purchase must be returned in new condition and complete. If a gift is not returned, the pre-specified value of the gift may be deducted from the refund to the extent permitted by law.
  • Promotional codes and discounts cannot be exchanged for money and cannot be restored after a return, unless otherwise expressly provided by the terms of the promotion or mandatory legislation.

19. Responsibility of the parties

  • The parties are responsible for violation of the contract within the limits established by the contract and mandatory legislation.
  • The Seller is not responsible for the consequences of incorrect measurements, address, contact information, size selection or other information provided by the Buyer.
  • Seller is not responsible for fees, conversions, import taxes, duties and third party services not received by Seller.
  • To the extent permitted by law, the Seller is not responsible for indirect damages, lost profits, loss of the opportunity to participate in the event and other consequences if a special date for use of the goods was not agreed in advance in writing as an essential condition of the order.
  • The total contractual liability of the Seller is limited to the amount of the relevant order, unless otherwise provided by mandatory legislation.
  • Nothing in the contract excludes liability that the law prohibits the exclusion or limitation of.

20. Force majeure

The party is released from liability for delay or impossibility of performance to the extent that this is caused by extraordinary and unavoidable circumstances beyond its reasonable control, including military actions, blockades, government bans, natural disasters, large-scale failures of energy, transport or information infrastructure. A party must notify the other party within a reasonable time. Force majeure does not exempt the Seller from returning money when the obligation to return is maintained by law.

21. Intellectual property

Photographs, descriptions, product designs, patterns, graphics, logos and other materials on the Site are protected by law. Their copying, commercial use or reproduction without the permission of the copyright holder is prohibited, except as expressly permitted by law.

22. Personal data and electronic communications

  • The data is processed for order processing and fulfillment, payment, delivery, returns, fraud prevention, fulfillment of accounting and legal obligations and protection of the legitimate interests of the parties.
  • Detailed conditions are set out in Privacy and Cookie Policy.
  • The buyer agrees to receive messages necessary to complete the order. Marketing communications are sent on a separate legal basis and may be disabled.
  • Electronic confirmations, correspondence, information system information, payment records, transport data, photographs and videos can be used as evidence of the order, approval of characteristics, dispatch, receipt and condition of the goods to the extent permitted by law.

23. Claims, applicable law and disputes

  • Before going to court, the parties are asked to submit a written claim with the order number, description of the requirements and available evidence. This does not limit the Consumer's right to apply to a competent authority or court if mandatory law does not allow such a limitation.
  • The legislation of Ukraine applies to the agreement.
  • The choice of Ukrainian legislation does not deprive the Consumer of mandatory protection, which cannot be canceled by the agreement and is provided by the applicable legislation of the country of his permanent residence.
  • The competent court and procedure for considering a dispute are determined by the mandatory rules of the applicable jurisdiction. The provision of the agreement does not limit the Consumer’s right to go to court in the place provided to him by mandatory legislation.

24. Change of conditions and validity of provisions

  • The version of the offer and related conditions in force at the time of conclusion of the contract is applied to the order, unless subsequent changes improve the Buyer’s position or the parties have not separately agreed on them.
  • The Seller has the right to change the terms and conditions for future orders and correct obvious typographical or technical errors.
  • If a particular provision is found to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
  • Headings are used for convenience and do not change the meaning of the terms.
